Impact Evaluation of Legislation in Basic Old-Age Pension Act: Focusing on the Eligibility Conditions and the Graded National Subsidies Ratio

Abstract

본 연구는 그동안의 연구들과 달리 법 규정 자체에 초점을 두고 입법영향평가를 시도하였다. 구체적으로는 2007년에 경로연금지급대상자가 아니었던 노인이 2008년 기초노령연금 지급대상자가 된 경우를 종속변수로 두고 기초노령연금법상의 지급대상 선정기준과 국가, 지방자치단체 간의 비용부담 규정을 독립변수로 하여 위계적 회귀분석을 실시하였다. 분석결과에 의하면 기초노령연금법상 소득인정액이 선정기준액 이하에 해당할수록 기초노령연금 수급권을 취득하였지만, 광역시 등 기초자치단체 국고 차등보조율 규정은 기초노령연금 수급권 취득에 ‘부수적’ 효과로서의 입법영향을 주었을 가능성을 보이고 있었다. 따라서 본 연구는 기초노령연금법 상 지급대상 선정기준 규정은 입법의 효과성 기준으로 볼때 연금수급권 취득 효과를 달성하였지만, 비용부담 규정은 입법의 ‘부수적’ 효과를 가져왔을 수 있다고 일견 평가할 수 있겠다.

Unlike previous studies, this study focused on the clauses in legislation and attempted to evaluate the impacts of the Eligibility Conditions and the Graded National Subsidies Ratio in Basic Senior Pensions Act. We used hierarchical regression analysis with the provisions of the Eligibility Conditions and the Graded National Subsidies Ratio as the independent variable. The independent variable was whether subjects, who didn’t receive pension for senior citizens in 2007, became recipients of the pensions in 2008 or not. Subjects of this study were 3,798 elderly from the Korea Welfare Panel Study 2008 and 2009 administered by Korea Institute for Health and Social Affairs and Seoul National University. The results of hierarchical regression analyses included; First, the impacts of the Eligibility Conditions were positively associated with increased elderly’s pension rights. Otherwise, the Graded National Subsidies Ratio was negatively associated with those rights. This study evaluated the effectiveness of the Eligibility Conditions and the incidental impacts of the Graded National Subsidies Ratio in Basic Senior Pensions Act.
